Attorney William E. O’Brien

Mr. O’Brien has gained experience in both corporate and law firm settings. As General Counsel for Plaut Consulting Inc., his duties included advising members of the Board of Directors and Officers of the corporation on all legal matters for the corporation; negotiating software implementation and outsourcing agreements, (often multi-million dollar transactions); coordinating and negotiating the sale of assets in the context of mergers and acquisitions; conducting and coordinating litigation with outside counsel; administering the firm’s immigration matters; coordinating and prosecuting intellectual property rights; managing of the corporations Waltham, Massachusetts facility including, negotiating sublease agreements, marketing of the property to potential sub-tenants; planning and coordination of tenant improvements to the building.

While corporate counsel to the Quantum Corporation, he supported the Advanced Products Group for the DLT Tape Division and the E-Business and E-Commerce sections. Selected projects included: negotiating and drafting complex technology and software license agreements for the SuperDLT product line with both foreign and domestic partners; drafting of international and domestic Terms and Conditions for the store; negotiating and drafting software license and technology agreements with various software vendors and service providers; development and prosecution of intellectual property worldwide for the company’s Advanced Products Group including coordination of projects with outside counsel; draft of employment agreements for the hiring of scientific personnel.

As an attorney in his own private practice and with the law firms of Walter, Conston, Alexander & Green (now Alston & Bird) and Fulbright & Jaworski, Mr. O’Brien negotiated and drafted complex software, intellectual property and technology license agreements for international clients; managed a docket of approximately 2,000 pending and registered patents, trademarks, copyrights and domain names, and litigated trademark issues before the U.S. Patent and Trademark Office Trademark Trial and Appeal Board and federal courts.

Mr. O’Brien began his career as an Attorney Advisor with the U.S. Department of Commerce, Patent and Trademark Office, in Washington, D.C., where he received the Special Achievement Award in 1990.

Educational Background:

Mr. O’Brien received his bachelor’s degree in German language and literature from the George Washington University in Washington, D.C. in 1979. After obtaining his B.A., Mr. O’Brien began his legal studies at the Ludwig-Maximilians-Universität in Munich, Germany. After graduating from the University of Munich, in 1986 with the equivalent of a German law degree, attended the State University of New York at Buffalo where he received his J.D. in 1988. After receiving his J.D., Mr. O’Brien was a research fellow at the Max-Planck-Institut für ausländisches und internationales Patent-, Urheber- und Wettbewerbsrecht in Munich, Germany where he studied issues involving international trademark and copyright law and completed his master’s thesis. He successfully defended his master thesis and received his Magister Legum in German Law from the Ludwig-Maximilians-Universität in Munich in 1992.
